1. Agreement to Terms

By accessing or using Polikeeper ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and Polikeeper.

2. Description of Service

Polikeeper is a software-as-a-service (SaaS) platform that provides insurance agents with tools for policy management, client tracking, document storage, and payment monitoring. The Platform is designed to assist agents in organizing and managing their insurance business operations.

4. Account Registration & Eligibility

To use the Platform, you must register for an account. By registering, you represent and warrant that:

• You are at least 18 years of age
• You are a licensed insurance agent or an authorized representative of a licensed insurance agency in Malaysia
• All information you provide during registration is accurate, complete, and current
• You will maintain the security of your account credentials and are responsible for all activities under your account

5. Agent Data Responsibilities

As an agent user, you are the data controller for any client, policyholder, or beneficiary data you enter into the Platform. You acknowledge and agree that:

• You have obtained all necessary consents from your clients and their beneficiaries for the collection, use, storage, and processing of their personal data through this Platform, in accordance with the Personal Data Protection Act 2010
• You have provided your clients with the required Personal Data Protection Notice before entering their data
• You are responsible for the accuracy and completeness of all client data you enter
• You will not enter any personal data into the Platform without lawful basis
• You will comply with all confidentiality obligations under the Financial Services Act 2013, including Section 133 regarding secrecy of customer information
• You will respond to data access and correction requests from your clients within the statutory 21-day period

6. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable regulations
• Upload, store, or transmit any data that infringes the rights of any third party
• Attempt to gain unauthorized access to any part of the Platform, other accounts, or systems
• Use the Platform to store or process personal data without the data subject's consent
• Share your account credentials with unauthorized individuals
• Reverse engineer, decompile, or disassemble any part of the Platform
• Use the Platform in any way that could damage, disable, or impair the service

7. Intellectual Property

The Platform, including its design, code, features, and documentation, is the intellectual property of Polikeeper and is protected by applicable copyright and trademark laws. You retain ownership of all data you enter into the Platform. By using the Platform, you grant us a limited license to process your data solely for the purpose of providing the service.

8. Limitation of Liability

To the maximum extent permitted by law, Polikeeper shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Platform.

The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or completely secure. We shall not be liable for any loss or damage resulting from unauthorized access to your account due to your failure to maintain the confidentiality of your credentials.

9. Data Security & Processing

We implement industry-standard security measures to protect data stored on the Platform. However, no method of electronic storage or transmission is 100% secure. By using the Platform, you acknowledge and accept the inherent risks of data transmission over the internet. Please refer to our Privacy Policy for detailed information on how we handle and protect your personal data.

10. Termination

You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate your account if you breach these Terms or engage in conduct that we reasonably believe is harmful to the Platform, other users, or third parties. Upon termination, your right to use the Platform ceases immediately. We will retain your data for a reasonable period as required by law before securely deleting it.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

12. Changes to These Terms

We may modify these Terms at any time by posting the updated version on this page. Material changes will be communicated through the Platform or via email. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
